JetSet Frequent Flyer Program Rules

Introduction
1. By participating in the JetSet Frequent Flyer Program (JetSet Program or Program) you agree to adhere to these ExpressJet Airlines, Inc. (ExpressJet) JetSet Program Rules (Rules). You are responsible for reading these Rules in order to understand your rights, responsibilities and status under the Program. The Rules apply only to flights that are operated and marketed for sale solely by ExpressJet. (ExpressJet Flight). These Rules do not apply to flights that are operated by ExpressJet but marketed by another airline (e.g., Continental Express, Delta Connection). ENROLLMENT
2. To enroll in the JetSet Program, go to www.expressjet.com and click on the JetSet tab. Other opportunities for enrollment may also be available through a preferred travel provider, at an ExpressJet ticket counter in a mail-in format, or through JetSet Desk at 1-866-958-XJTR (9587). Following any announcement of Program termination, no further enrollments will be accepted.

3. Membership in the Program is for individual travelers only. Members must enroll separately using a unique email address, if available, and may not pool or combine JetSet Points with other Members. Each Member may have only one (1) account, and must provide his or her first name, last name, address, date of birth, and unique email address, if available, upon registration. Members may also be required to provide other information for the purpose of insuring secure access to their Membership account. Corporations, other entities, charterers of all or a portion of a flight, charter passengers, animals, or blocked-seat purchasers are not eligible to enroll as Members or to qualify for JetSet Points or JetSet Awards.

4. Membership will be granted by ExpressJet through enrollment in the JetSet Program. ExpressJet permits minors (children under the age of 18) to be Members of the JetSet Frequent Flyer Program. Membership in the JetSet Program by any minor under age 18 requires enrollment by the minor’s parent or legal guardian directly with the JetSet Desk. Online enrollments of minors will not be accepted to protect the privacy of minors. Parents or legal guardians should carefully review ExpressJet’s Privacy Policy, which may be accessed by clicking on the following link: privacy. ExpressJet’s Privacy Policy discloses ExpressJet’s online information practices, including the information ExpressJet collects and how ExpressJet uses that information. Awards received through a minor’s accumulation of JetSet Points will be maintained in the minor’s account. ExpressJet will not be responsible for replacing a minor’s JetSet Points or Awards utilized by either parent or legal guardian without the consent of the other parent or legal guardian.

ACCRUAL OF JETSET POINTS AND BENEFITS OF MEMBERSHIP
5. Members of the JetSet Program can accrue JetSet Points which can be redeemed for JetSet Travel Awards (Award) or other partner awards if available. JetSet Points are accrued pursuant to these Rules, which are available at expressjet.com under the JetSet tab. Members will choose when to redeem their Jetset Points for Awards provided they do so prior to termination of the JetSet Program. Awards will no longer be automatically issued to a Program Member once enough qualifying JetSet Points are accumulated in a Member’s account.

6. ExpressJet will award ten (10) JetSet Points for each flight segment (one-way trip) taken on an ExpressJet Flight. Each one way trip is worth ten (10) JetSet Points; a round trip is worth twenty (20) JetSet Points. A flight from one destination to another, even if there is a stop, but no plane or flight number change, is considered one (1) segment and is worth ten (10) JetSet Points. No overnight stay is required to accrue a JetSet Point. JetSet Points are considered earned on the date a member completes a one-way trip. JetSet Points will be credited to a Member’s account within 48 hours of a completed flight segment. JetSet Points will not be earned on an Award flight(s).

7. Members must personally travel on ExpressJet Flights to earn JetSet Points. JetSet Points will not be awarded on unused, cancelled, forfeited, refunded, or fraudulently obtained reservations, including reservations made for the same flight under the same passenger name. JetSet Points can only be accumulated one time per flight segment per Member, regardless of the number of seats purchased by the Member, except when ExpressJet policies require a passenger to purchase a second seat to adhere to the provisions of ExpressJet’s Contract of Carriage Only the person named as a JetSet Program Member in the records of ExpressJet and who actually flies on an ExpressJet flight segment operated and marketed solely as ExpressJet Airlines can earn JetSet Points, even if the Member purchases tickets for other individuals.

8. In the case of a delay or cancellation of an ExpressJet Flight, except as a result of the termination of all ExpressJet Flights at a city or systemwide, and where a Member has been accommodated by ExpressJet using the services of another airline, the Member will still accrue JetSet Points as described in the Rules. Such flights will not count toward the accumulation of points or miles of any loyalty program offered by the other airline. It is the Member’s responsibility to email jetset@expressjet.com or call 1-866-958-XJTR (9587) and provide a copy of their boarding pass, flight number, date of travel, and JetSet Program Membership account number to ExpressJet in order to accrue JetSet Point(s) for the flight(s) taken on another airline due to an ExpressJet Flight delay or cancellation where the member was accommodated by ExpressJet on another airline. Nothing herein shall obligate ExpressJet to accommodate those holding JetSet Awards to use the services of another airline.

9. In addition to Awards, ExpressJet may from time to time offer "bonus" awards or credits, partnership programs, or promotional incentives for JetSet Members' use, such as JetSet BuX, rental car discounts, hotel discounts, or other discounts. Such offers are not a part of the program’s formal award structure and may be temporary. ExpressJet reserves the right to modify or eliminate such offers at any time. The offers are void where prohibited by law. Promotional offers, when available, may be found at expressjet.com or through a preferred travel provider.

10. JetSet Travel Awards are transferable, but JetSet Points are not. JetSet Points cannot be purchased. JetSet Points and Awards have no cash value and may not be redeemed for cash. Tax consequences of JetSet Points Awards, if any, are the responsibility of the JetSet Program Member.

11. Only ExpressJet’s records will be used to determine a Member’s status including the number of JetSet Points held and Awards for which any Member is eligible. Members are responsible for ensuring that JetSet Points and Awards are properly credited. If, prior to the termination of the JetSet Program, a Member believes that JetSet Points or Awards have been not properly credited, they are required to submit documentation or other proof satisfactory to ExpressJet, which may include copies of boarding passes, receipts and/or confirmation number. Whether or not the Member received or viewed their monthly JetSet Program statement, any claim for uncredited JetSet Points must be received by ExpressJet by the earlier of (i) within six (6) months after the date any Qualifying Flight (as defined in Section 15) was taken, or (ii) at least thirty (30) days prior to the date of termination of the JetSet Program.

12. Each Member will be responsible for remaining knowledgeable about his or her account information, accumulated JetSet Points, Award status, Award expiration and the JetSet Program Rules. Information regarding the status of a Member’s account, number of JetSet Points for travel flown, and/or Awards issued will be communicated in monthly account statements and can also be obtained by emailing jetset@expressjet.com or calling 1-866-958-XJTR (9587). Members who supply an email address to ExpressJet will receive monthly JetSet account statements via email. Members who do not have an email address on record, or those that elect to receive a written statement via U.S. mail, will receive monthly account statements via U.S. mail only if they have acquired JetSet Points or if other new activity has occurred in the member’s account in the immediately preceding month. All members will receive a written or electronic annual statement of their account after the end of each calendar year. It is the responsibility of each member to monitor their JetSet Points.

13. Members can change their address and other personal contact information by logging in to their JetSet Account at expressjet.com, by emailing jetset@expressjet.com, or by calling the JetSet Desk at 1-866-958-XJTR (9587). Requests for name changes must be done via email or phone and may require supporting legal documentation.

JETSET TRAVEL AWARD QUALIFICATION RULES
14. Members qualify for a JetSet Travel Award pursuant to the following formula:

Points Award
Roundtrip Award 160 Points Two (2) one-way travel certificates good for one (1) round trip ticket or two (2) one-way trips on flights on any day of the week that are operated and marketed for sale solely by ExpressJet at the time the transportation is provided. Restrictions may apply.
FlexTravel Roundtrip Award 120 Points Two (2) one-way travel certificates good for one (1) round trip ticket for travel ONLY on Tuesday, Wednesday, or Saturday. Both flight segments must be flown on Tuesday, Wednesday, or Saturday to qualify for this Award. Award travel may only be used on flights operated and marketed for sale solely by ExpressJet at the time the transportation is provided. Restrictions may apply.
One-way Award 80 Points One (1) one-way travel certificate good for one (1) one-way trip on flights on any day of the week operated and marketed for sale solely by ExpressJet at the time the transportation is provided. This award may be combined with other one-way Travel Award Certificates for round trip travel. Restrictions may apply.

Once a Member has accumulated the required number of JetSet Points in the Program, the Member may choose to redeem Points for an Award online at www.expressjet.com at which time award codes will be issued. Awards and award codes will be issued by email to email address during the Point redemption process. Award codes are required to make all Award flight reservations. Award reservations can only be made by calling the JetSet Desk at 1-866-958-XJTR (9587). To cancel and or change Award flight reservations, Members must call the JetSet Desk at 1-866-958-XJTR (9587). Other awards may be added from our Travel Partners from time to time. These Awards are not a part of the Program’s formal Award structure and may be temporary.

15. JetSet Travel Awards are redeemable only for ExpressJet Flights via the most direct or applicable routes as published in the current ExpressJet flight schedule (Qualifying Flight). Awards are subject to seat restrictions, and seats will not be available for Award travel on all flights on all days. It may be particularly difficult to secure a seat around holidays such as Thanksgiving, Christmas, New Year’s, President’s Day, some weekends during Spring Break, Memorial Day, July 4th, and Labor Day to popular destinations.

16. In connection with Awards, ExpressJet will collect and Members are responsible for the payment of the government’s September 11th security fees of up to $10.00 per round trip. If applicable, the Member is solely responsible for payment of all federal transportation excise taxes and fees, passenger facility charges, inspection fees, customs, user and immigration fees, departure fees, and any other taxes, fees, or surcharges on Award travel. All such taxes, fees and surcharges must be paid by credit card, or other approved method, at the time the Award reservation is booked.

EXPIRATION OF JETSET POINTS AND AWARDS
17. JETSET POINTS EXPIRE 24 MONTHS AFTER THE DATE THEY ARE EARNED. JETSET POINTS ARE EARNED ON THE DATE EACH ONE-WAY QUALIFYING FLIGHT IS COMPLETED.

18. JETSET AWARDS EXPIRE AT THE END OF THE MONTH THAT OCCURS ONE YEAR AFTER THE DATE THE JETSET AWARD WAS ISSUED, WHETHER OR NOT THE MEMBER MAKES A RESERVATION FOR AWARD TRAVEL DURING THE ONE YEAR PERIOD. ALL AWARD TRAVEL, ONCE EARNED, MUST BE COMPLETED WITHIN THIS ONE YEAR PERIOD.

19. ExpressJet will close JetSet Program Member accounts that have not had any JetSet Point or Award activity for four (4) years.

CHANGES OR CANCELLATIONS TO REDEEMED JETSET AWARDS
20. After a Roundtrip or One-Way Travel Award has been issued to a Member and the Member has booked a Qualifying Flight using the Award, a Member may book an alternative flight or may cancel their reservation free of charge. If a Member cancels his or her Award reservation, the original expiration date for the Award still will remain in effect. Any payment for fees or taxes made in accordance with Section 15 will be refunded to the customer in the same form of payment originally used by the customer. If the Member does not cancel or change his or her reservation before scheduled departure, the Award and all associated fees will be forfeited. In either case, if ExpressJet cancels an Award reservation or flight and does not reaccommodate the Member, the original Award expiration date will still apply; however, if the expiration date of the Award is within fourteen (14) days of the scheduled departure date of the cancelled Award flight, the expiration date will automatically be extended by an additional thirty (30) days.

LIMITATION OF REMEDIES
21. If ExpressJet improperly denies a Member any JetSet Points, an Award, or some other benefit of the JetSet Program, the Member’s exclusive remedy shall be the issuance of the improperly denied JetSet Points, Award, or such other alternative benefit as determined by ExpressJet. Other than making such benefit available, ExpressJet shall have no additional liability whatsoever to a Member or anyone claiming through a Member or on a Member’s behalf. In no event shall ExpressJet be liable to any Member or anyone claiming through a Member or on a Member’s behalf for any direct, indirect, or consequential damages or lost revenue or profits, arising out of ExpressJet’s acts or omissions in connection with the JetSet Program.

22. FlexTravel Awards are only valid for travel on a Tuesday, Wednesday, or Saturday only. If the Member makes a reservation with a FlexTravel Award on any other day (i.e. Monday, Thursday, Friday or Sunday), or changes a reservation from Tuesday, Wednesday or Saturday to any other day of the week, the Member will be charged 40 additional JetSet Points to convert the FlexTravel Award into a Standard Travel Award. If 40 additional JetSet Points are not available in the member’s account, the Member must either travel as originally planned on a Tuesday, Wednesday or Saturday, or save the FlexTravel Award for a future trip and buy a ticket on ExpressJet for the desired travel date. FlexTravel Awards can be re-booked or canceled free-of-charge as long as the new reservation is for travel on a Tuesday, Wednesday or Saturday. If a Member cancels his or her Award reservation, the original expiration date for the Award still will remain in effect. Any payment for fees or taxes made in accordance with Section 15 will be refunded to the customer in the same form of payment originally used by the customer. If the Member does not cancel or change his or her reservation before scheduled departure, the Award and all associated fees will be forfeited. In either case, if ExpressJet cancels an Award reservation or flight and does not reaccommodate the Member, the original Award expiration date will still apply; however, if the expiration date of the Award is within fourteen (14) days of the scheduled departure date of the cancelled Award flight, the expiration date will automatically be extended by an additional thirty (30) days.

ADDITIONAL PROVISIONS
23. ExpressJet may, among other things, (i) cancel, terminate, revoke, suspend or modify any Program rules for point levels, awards, conditions of participation and partner affiliations or any other terms and conditions including but not limited to the JetSet Program Rules and all requirements for Awards with no notice and at any time or (ii) terminate the JetSet Program in its entirety with thirty (30) days prior written notice to a Member, by email for those Members who have elected to provide an email address, or for those without a email address or who have elected to receive notices by mail, by U.S. mail . Therefore, under either circumstance, Members may not rely upon the continued availability of any JetSet Program feature or any JetSet Award, whether or not a JetSet Award has been issued or a reservation for JetSet Award Travel has been made. Upon termination of the JetSet Program and otherwise, JetSet Points and Awards have no cash value and may not be redeemed for cash.

24. Use of the expressjet.com site is subject to ExpressJet’s Privacy Policy, the terms of which are incorporated herein. By registering for this JetSet Program, you have acknowledged that you have read the ExpressJet Privacy Policy and agree that your acceptance of these terms is also your consent to the information practices set forth in ExpressJet’s Privacy Policy.

25. Fraud, misrepresentation, abuse or violation of applicable rules (including, but not limited to ExpressJet’s Contract of Carriage, tariffs and the JetSet Program Rules) may result in administrative and/or legal action by appropriate governmental authorities and/or ExpressJet. Such action may include, without limitation, the forfeiture of all Awards, reservations issued against Awards, and any accumulated JetSet Points in a Member’s account, as well as cancellation of the account and the Member’s future participation in the Program. In addition, ExpressJet reserves the right to take appropriate legal action to recover damages, including attorneys’ fees, incurred in prosecuting any lawsuit.

26. ExpressJet reserves the right to audit any and all JetSet Program Member accounts at any time for compliance with the Program rules, without notice to the Program Member. In the event the audit reveals discrepancies or possible violations of the terms and conditions, the processing of Award redemption requests may be delayed pending completion of the audit.

27. ExpressJet shall attempt to advise active Members of various matters of interest through its website and/or through email, but ExpressJet shall have no responsibility to do so.

28. ExpressJet shall have no liability for correspondence, mail, or email, which is lost, delayed, or misdirected.

29. ExpressJet shall not be liable for a lost or stolen password, email address, award code, or Membership account number.

30. All JetSet Program rules may be modified from time to time, are subject to interpretation by ExpressJet.

31. Awards, JetSet Points and any special offers to JetSet Members are subject to applicable government regulations and are void where prohibited by law.

32. Travel provided by ExpressJet is subject to the terms and conditions of the ExpressJet Contract of Carriage.

33. Other restrictions may apply
