INTRODUCTION
1. By participating in the JetSet Frequent Seller/Non-Stop Rewards Program (JetSet Seller/Non-Stop Rewards Program or Program) you agree to adhere to these ExpressJet Airlines, Inc. (ExpressJet) JetSet Seller/Non-Stop Rewards Program Rules (Rules). You are responsible for reading these Rules in order to understand your rights, responsibilities and status under the Program. The Rules apply only to flights that are operated and marketed for sale solely by ExpressJet (ExpressJet Flight). These Rules do not apply to flights that are operated by ExpressJet but marketed by another airline (e.g., Continental Express, Delta Connection). ENROLLMENT
2. To enroll in the JetSet Seller Program either, go to www.xjet.com and click on the JetSet tab, fax the enrollment form to ExpressJet JetSet at 1-800-966-5616, or email the required enrollment information to JetSet Seller/Non-Stop Rewards Program.
3. Membership in the Program is for individual travel agents only. Members must enroll separately using a unique email address, if available, and may not pool or combine JetSet Points with other Members. Each Member may have only one (1) account, and must provide his or her first name, last name, date of birth, agency name, agency address, ARC number, agency fax number and unique email address, if available, upon registration. Members may also be required to provide other information for the purpose of insuring secure access to their Membership account. Non-travel agents, corporations, other entities, charterers of all or a portion of a flight, charter passengers, animals, or blocked-seat purchasers are not eligible to enroll as Members or to qualify for JetSet Points or JetSet Awards.
4. Membership will be granted by ExpressJet through enrollment in the JetSet Seller /Non-Stop Rewards Program. Minors under the age of 18 are not permitted to join the Program.
ACCRUAL OF JETSET POINTS AND BENEFITS OF MEMBERSHIP
5. Members of the JetSet Seller Program can accrue JetSet Points which can be redeemed for JetSet Travel Awards (Award). JetSet Seller/Non-Stop Rewards Program are accrued pursuant to these Rules, which are available at program rules. An Award will be issued automatically to a Program Member once enough qualifying JetSet Points are accumulated in a Member’s account.
6. ExpressJet will award one (1) JetSet Point for each flight segment (one-way trip) booked by the Member on an ExpressJet Flight. Each one way trip is worth one (1) JetSet Point; a round trip is worth two (2) JetSet Points. A flight from one destination to another, even if there is a stop, but no plane or flight number change, is considered one (1) segment and is worth one (1) JetSet Point. No overnight stay is required to accrue a JetSet Point. Each JetSet Point is considered earned on the date the booked customer completes the associated one-way trip. No JetSet Points will be awarded for a booking only.
ExpressJet will also award one (1) JetSet Point for each new customer enrollment in the ExpressJet Frequent Flyer Program. The Member must verify that the customer agrees to enrollment prior to submitting the customer enrollment to ExpressJet. The JetSet Point for enrollment will only be awarded for a new customer enrollment and will be awarded only after the enrolled customer has completed their first one-way trip. No JetSet Points will be awarded for an enrollment only.
7. To obtain credit for bookings, the travel agent must either email (info@jetsetprogram.com) or fax (1-800-966-5616) the following information: customer name, flight number, date of flight, originating city, destination city, agent name, ARC number, and Member’s unique JetSet Frequent Seller number. Information must be sent to ExpressJet within 6 months of the date that the customer completed a Qualifying Flight to obtain credit.
To obtain credit for customer enrollments, the Member must fill in their name, ARC number, and unique JetSet Seller/Non-Stop Rewards Program number on the customer enrollment form.
JetSet Points will not be awarded on unused, cancelled, forfeited, refunded, or fraudulently obtained reservations, including reservations made for the same flight under the same passenger name. JetSet Points can only be accumulated one time per booking. Only the person named as a JetSet Program Member in the records of ExpressJet and who actually books an ExpressJet Flight operated and marketed solely as ExpressJet Airlines can earn JetSet Points after the booked flight is flown.
JetSet Points will not be awarded on customer enrollments that are duplicated (e.g., for a customer who already held a Membership), forged, or fraudulently obtained.
8. JetSet Travel Awards are transferable, but JetSet Points are not. JetSet Points cannot be purchased. JetSet Points and Awards have no cash value and may not be redeemed for cash. Tax consequences of JetSet Points Awards, if any, are the responsibility of the JetSet Program Member.
9. Only ExpressJet’s records will be used to determine a Members status including the number of JetSet Points held and Awards for which any Member is eligible. Members are responsible for ensuring that JetSet Points and Awards are properly credited. If a Member believes that JetSet Points or Awards have been not properly credited, they are required to submit documentation or other proof satisfactory to ExpressJet, which may include receipts and/or confirmation number. Any claim for uncredited JetSet Points or Awards must be received by ExpressJet within nine (9) months after the date that the customer completed a Qualifying Flight (as defined in Section 13), whether or not the Member has received or viewed their monthly JetSet Program statement to determine whether credit was given for any booking(s).
10. Each Member will be responsible for remaining knowledgeable about his or her account information, accumulated JetSet Points, Award status, Award expiration and the JetSet Program Rules. Information regarding the status of a Member’s account, number of JetSet Points for travel flown, and/or Awards issued will be communicated in monthly account statements and can also be obtained by emailing info@jetsetprogram.com. Members who supply an email address to ExpressJet will receive monthly JetSet account statements via email. Members who do not have an email address on record, or those that elect to receive a written statement via U.S. mail, will receive monthly account statements via U.S. mail only if they have acquired JetSet Points or if other new activity has occurred in the member’s account in the immediately preceding month. All members will receive a written or electronic annual statement of their account after the end of each calendar year. It is the responsibility of each member to monitor their JetSet Points.
11. Personal contact information can be changed by a Member by contacting the JetSet Seller/Non-Stop Rewards Program via fax, 1-800-966-5616, or by emailing info@jetsetprogram.com. Requests for name changes may require supporting legal documentation.
JETSET TRAVEL AWARD QUALIFICATION RULES
12. Members qualify for a JetSet Travel Award pursuant to the following formula:

Once a Member has accumulated the required number of JetSet Points in the Program the Award and award code will be issued. Awards and award codes will be issued by email if an email address is on file for a member; otherwise, an Award and award code will be sent by mail to the member. The award code is required to make all Award flight reservations. Award reservations must be made by calling ExpressJet Reservations at 1-866-958-VIPS (8477). To cancel and or change Award flight reservations, Members must call ExpressJet Reservations at 1-866-958-VIPS (8477).
13. JetSet Travel Awards can be used for a one way or a round trip flight on an ExpressJet Flight. Awards are redeemable only for ExpressJet Flights via the most direct or applicable routes as published in the current ExpressJet flight schedule (“Qualifying Flight”). Awards are subject to seat restrictions, and seats will not be available for Award travel on all flights on all days. It may be particularly difficult to secure a seat around holidays such as Thanksgiving, Christmas, New Year’s, President’s Day, some weekends during Spring Break, Memorial Day, July 4th, and Labor Day to popular destinations. A Member may make his or her Award available for use by any other person.
14. In connection with Awards, ExpressJet will collect and Members are responsible for the payment of the government’s September 11 security fees up to $10.00 per round trip. If applicable, the Member is responsible for payment of all federal transportation excise taxes and fees, passenger facility charges, inspection fees, customs, user and immigration fees, departure fees, and any other taxes, fees, or surcharges on Award travel. Taxes, fees and surcharges must be paid by credit card, or other approved method, at the time the Award reservation is booked.
15. In addition to Awards, ExpressJet may from time to time run promotions that may be available to some or all JetSet Seller/Non-Stop Rewards Program Members. Although these promotions do not change the Program’s formal award structure as described herein, these promotions may on a LIMITED AND TEMPORARY basis supersede the formal awards structure. ExpressJet reserves the right to modify or eliminate all promotional offers at any time. Promotional offers are void where prohibited. Promotional offers, when available, may be found at www.xjet.com or through a preferred travel provider.
EXPIRATION
16. JETSET POINTS EXPIRE 24 MONTHS AFTER THE DATE THEY ARE EARNED. JETSET POINTS ARE EARNED ON THE DATE EACH ONE-WAY QUALIFYING FLIGHT IS COMPLETED BY CUSTOMER.
17. JETSET AWARDS EXPIRE AT THE END OF THE MONTH THAT OCCURS ONE YEAR AFTER THE DATE THE JETSET AWARD WAS EARNED, WHETHER OR NOT THE MEMBER MAKES A RESERVATION FOR AWARD TRAVEL DURING THE ONE YEAR PERIOD. ALL AWARD TRAVEL, ONCE EARNED, MUST BE COMPLETED WITHIN THIS ONE YEAR PERIOD.
18. ExpressJet will close JetSet Seller/Non-Stop Rewards Program Member accounts that have not had any JetSet Point activity for four (4) years.
CHANGES OR CANCELLATIONS TO REDEEMED JETSET AWARDS
19. After an Award has been issued to a Member and the Member has booked a Qualifying Flight using the Award, a Member may book an alternative flight or may cancel their reservation free of charge. If a Member cancels his or her Award reservation, the original expiration date for the Award still will remain in effect. Any payment for fees or taxes made in accordance with Section 15 will be refunded to the customer in the same form of payment originally used by the customer. If the Member does not cancel or change his or her reservation before departure, the Award and all associated fees will be forfeited. In either case, if ExpressJet cancels an Award reservation or flight and does not reaccommodate the Member, the original Award expiration date will still apply; however, if the expiration date of the Award is within fourteen (14) days of the scheduled departure date of the cancelled Award flight, the expiration date will automatically be extended by an additional thirty (30) days.
LIMITATION OF REMEDIES
20. If ExpressJet improperly denies a Member any JetSet Points, an Award, or some other benefit of the JetSet Seller/Non-Stop Rewards Program, the Member’s exclusive remedy shall be the issuance of the improperly denied JetSet Points, Award, or such other alternative benefit as determined by ExpressJet. Other than making such benefit available, ExpressJet shall have no additional liability to a Member or anyone claiming through a Member or on a Member’s behalf whatsoever. In no event shall ExpressJet be liable to any Member or anyone claiming through a Member or on a Member’s behalf for any direct, indirect, or consequential damages or lost revenue or profits, arising out of ExpressJet’s acts or omissions in connection with the JetSet Seller/Non-Stop Rewards Program.
ADDITIONAL PROVISIONS
21. ExpressJet may, among other things, (i) cancel, terminate, suspend or modify any Program rules for point levels, awards, conditions of participation and partner affiliations or any other terms and conditions including but not limited to the JetSet Seller/Non-Stop Rewards Program Rules and all requirements for Awards with no notice and at any time or (ii) terminate the JetSet Seller/Non-Stop Rewards Program with twelve (12) months prior written notice to a Member. Therefore, Members may not rely upon the continued availability of any Award.
22. Use of the www.xjet.com site is subject to ExpressJet’s Privacy Policy, the terms of which are incorporated herein. By registering for this JetSet Program, you have acknowledged that you have read the ExpressJet Privacy Policy and agree that your acceptance of these terms is also your consent to the information practices set forth in ExpressJet’s Privacy Policy.
23. Fraud, misrepresentation, abuse or violation of applicable rules (including, but not limited to ExpressJet’s Contract of Carriage, tariffs and the JetSet Seller Program Rules) may result in administrative and/or legal action by appropriate governmental authorities and/or ExpressJet. Such action may include, without limitation, the forfeiture of all Awards, reservations issued against Awards, and any accumulated JetSet Points in a Member’s account, as well as cancellation of the account and the Member’s future participation in the Program. In addition, ExpressJet reserves the right to take appropriate legal action to recover damages, including attorneys’ fees, incurred in prosecuting any lawsuit.
24. ExpressJet reserves the right to audit any and all JetSet Seller/Non-Stop Rewards Program Member accounts at any time for compliance with the Program rules, without notice to the Program Member. In the event the audit reveals discrepancies or possible violations of the Terms and Conditions, the processing of Award redemption requests may be delayed pending completion of the audit.
25. ExpressJet shall attempt to advise active Members of various matters of interest through its website and/or through email, but ExpressJet shall have no responsibility to do so.
26. ExpressJet shall have no liability for correspondence, mail, or email, which is lost, delayed, or misdirected.
27. ExpressJet shall not be liable for a lost or stolen password, email address, award code, or Membership account number.
28. All JetSet Seller/Non-Stop Rewards Program rules and these Rules as both may be modified from time to time are subject to interpretation by ExpressJet.
29. Awards, JetSet Points and any special offers to JetSet Members are subject to applicable government regulations and are void where prohibited by law.
30. Travel provided by ExpressJet is subject to the terms and conditions of the ExpressJet Contract of Carriage.
